According to federal law, even the simplest mobile phone must be able to collect the user’s location data so that the emergency services can respond appropriately in emergencies. However, the current Obama administration wants to use this information for its own purposes.
In line with the Washington Times report, the Department of Justice submitted a brief statement to the US Court of Appeals last month. They insisted that the authorities had the right to collect tracking data on their cell phones for 60 days without being justified for a possible reason.
If it is claimed that this detailed data is related to the criminal investigation, it is likely that the authorities would not have real access to anyone’s movement. In the current case, federal agents searched for the movement history of certain T-Mobile and MetroPCS customers, but the federal judge ruled that the presumption of the authorities that these persons could be prosecuted was sufficient to obtain general subscriber data, such as his name and his Address, even more convincing evidence must be submitted to the court to force the publication of all location data.
The administration has appealed this judgment to the district court, discussing location information that contains important third-party business records that are not subject to data protection at all. The judge ruled that this was an absolute violation of the 4th change.
The main concern is that by giving the authorities access to each person’s private location data over a period of two months, a complete picture of a person’s life can be shown. The information could show all friends, political inclinations, co-workers, religious affiliations and hobbies of the person and even bad habits like playing. Such sensitive data could be misused to blackmail political enemies as easily as it could be used to uncover organized crime groups.
Nevertheless, the opposite side also deserves attention. There would probably be few people who would not mind the authorities persecuting those they consider to be very dangerous to the public, such as drug kings, sex offenders and suspected terrorists.
